Bolivia’s new constitution to allow casinos

Gambling regulation now needed

The new political constitution (CPE) in Bolivia has removed the law that prohibits the operation of casinos and slots parlours. This leaves the section of the Civil Code that penalises owners and operators of such businesses without effect. It also opens the possibility of regulating the activity in the South American country.

Executive Director of the Bolivian National Lottery (Lonabol), Marco Antonio Cardenas, said, “This new Act in the CPE has repealed Articles 909 and 915 of the Civil Code, which forbade all gambling games except the lottery.“ However, with casinos and slots operations illegal no longer a regulatory limbo has been created.

In respect of licensing authorities, Cardenas says the CPE indicates that both the central administration and the autonomous regions should be involved in licensing gambling premises and companies. In 2008 Lonabol presented a proposal to split gaming tax between the State (35%) and Lonabol (65%) for distribution to social programmes. (E-03.13.09)
