UIGEA challenged through the Courts

DoJ to defend iMEGA suit

On Tuesday this week the US 3rd Circuit Court of Appeals announced it will hear oral arguments from lawyers representing the Interactive Media & Entertainment & Gaming Association (iMEGA) and the US Department of Justice in the court challenge brought by iMEGA against the Unlawful Internet Gambling Enforcement Act (UIGEA). iMEGA was founded to foster cooperation between the online industry and government at all levels, and to promote innovation, openness and freedom on the Internet.

Arguments will be heard on July 7th at the US Courthouse in Philadelphia, Pennsylvania. The three judge panel that will hear the case consists of appointees from the administrations of Carter, Clinton and George W Bush. IMEGA will be represented by former US deputy attorney-general and professor at George Washington University school lo law, Stephen A Saltzburg, and Eric M Bernstein, who first argued to have UIGEA overturned in US District Court.

The defendants are the US Department of Justice, the Federal Trade Commission and the Federal Reserve. iMEGA chairman Joe Brennan Jr said, “This law will finally have to stand on it’s own two feet in court, free from politics and all other outside influences. We feel very confident that when the judges take a look at the law, they will see just how defective it is, and they will overturn it.”
