National Indian Gaming Commission extends Class II public comment period

CONSIDERING DEFINITIONS

Yesterday the National Indian Gaming Commission (NIGC) announced it was extending the period for the public to comment on proposed definitions, classification standards and technical regulations for Class II gaming machines. The comment period will now be extended through 15 December. The NIGC is an independent regulatory agency within the US Department of the Interior and was created under the Indian Gaming Regulatory Act 1988.

According to Paul Hogan, NIGC Chairman, “We are continuing to receive productive and thoughtful comments on this critically important issue. We want to give everyone with an interest the opportunity to have their comments on the record.” The new regulations will seek to clearly distinguish technological aids that Indian Tribes may utilize to play bingo and similar Class II games without a Tribal-State compact, from slot machines and electronic facsimiles of games of chance which are Class III devices requiring a tribal-state compact.

On 11 August the NIGC published proposed technical standards for electronic, computer or other technological aids used in the play of Class II games. No such standards currently exist and the proposed rules would establish technical standards for bingo, lotto, games similar to bingo, pull tabs and games played through technological aids, assuring the integrity of such games before they can be placed in gaming operations.
